Loyalty Program Terms and Conditions

Effective Date: October 22, 2020. The following supersedes all prior Terms and Conditions. By participating or continuing to participate after the effective date, you agree to the Privacy Policy and Terms and Conditions of PACIFICPOINTS.


1.PACIFICPOINTS is a Loyalty Coalition Program managed and operated by CPL Pacific, LLC. wherein members may earn and redeem points in accordance with the Terms and Conditions contained herein.
2.Any use or participation in PACIFICPOINTS, which includes use of the Membership Card, Website and/or Mobile App, shall constitute acceptance of both the Terms and Conditions and the Privacy Policy, including all amendments as may be made by PACIFICPOINTS in its sole discretion from time to time.
3.PACIFICPOINTS and its Terms and Conditions, as amended from time to time, shall be governed by the laws of Guam and both Member and PACIFICPOINTS agree to submit to the exclusive jurisdiction of the courts of Guam.

Membership and Eligibility

4. Any individual at least 16 (sixteen) years old, desiring to become a PACIFICPOINTS Member must complete and submit the online application form prescribed by PACIFICPOINTS.
Applicants will be required to provide a valid email address which will be the unique identifier for account creation.
To complete the account registration, Applicant will be required to access the email activation link sent to the registered email address.
Upon successful account registration, Member shall be assigned with a PACIFICPOINTS Virtual Card, free of charge, with unique membership account number, QR code and barcode.
5.Executives, employees, agents and representatives of CPL Pacific, LLC., its Partners and Affiliates are eligible for PACIFICPOINTS Membership but may be excluded from certain promotions.
6.Members must keep PACIFICPOINTS informed of any changes to their profile by ensuring that the details are up to date on their account. To make any changes to their profile, members may log in to their PACIFICPOINTS account via the Mobile App or through the Member’s Portal.
7.PACIFICPOINTS shall not be liable for any claims, demands, liabilities or actions arising out of or in connection with the Program or the use of the Card where such claims, demands, liabilities or actions would not have arisen but for the Card Members failure to notify PACIFICPOINTS of such changes.
8.Only one PACIFICPOINTS membership may be registered per person. Individuals with multiple memberships may result in their accounts being deactivated and points forfeited.
9. Members will be assigned a membership tier based on points earned. Tier upgrade will happen when Member earns the required minimum points for the tier rank. Every year, membership tier is assessed based on annual points earned and tier downgrade will be effected if Member fails to maintain tier rank minimum points requirement.

10.The PACIFICPOINTS Virtual Card, issued upon successful membership registration and manifested on Member’s Portal and Mobile App, shall be adequate as identifier of PACIFICPOINTS membership.
11.Should the member wish to request for a PACIFICPOINTS Physical Card, he/she may do so by contacting the Customer Hotline. Members shall be entitled to one PACIFICPOINTS Physical Card only.
12.The PACIFICPOINTS Virtual or Physical Card (“Card”) is not a credit card or charge card and is non-transferable. The use of the Card is solely restricted to the person to whom the Card is issued and for use in connection with PACIFICPOINTS.
13.The Card shall remain the property of PACIFICPOINTS at all times and must be surrendered to PACIFICPOINTS immediately upon request. PACIFICPOINTS may, at its sole discretion, terminate the membership or Program or the use of the Card at any time without notice or reason.
14.The Card Member shall take necessary security measures to ensure the proper and valid use of the Card.
15.PACIFICPOINTS shall not be liable, in the absence of willful misconduct or gross negligence on the part of PACIFICPOINTS or its employees for any loss or damage suffered by the Member arising out of or in connection with the use of the Card.

Lost / Stolen PACIFICPOINTS Card

16.Lost, damaged or defective cards must be reported immediately to the PACIFICPOINTS Customer Service Hotline.
17.If a Card is lost, PACIFICPOINTS may, at its discretion, issue a replacement Card. Costs for replacement and delivery may be passed to customer at a cost of 300 PACIFICPOINTS.
18.Where a Card is damaged or is defective, a replacement Card will be issued, at PACIFICPOINTS’ discretion, to the Card Member.
19.Upon notification of loss, damage or defect, any points resident in the lost, damaged or defective Card may, at PACIFICPOINTS’ discretion, be credited to the replacement Card. PACIFICPOINTS shall not be held liable for the loss of any accumulated points due to card loss, damage or defect. Any fees and/or charges payable by the Member in accordance with this Clause or with any other provisions herein may, at PACIFICPOINTS’ discretion, be paid by cash or way of deduction of equivalent points based on the prevailing rate, as may be determined by PACIFICPOINTS from time to time.

Account Validity

20.PACIFICPOINTS account will remain active as long as at least one point earning or redemption is made within a continuous period of 12 months. In case account is deactivated, all remaining points balance will be forfeited.
21.Any abuse or fraud with respect to points under the Program or redemption of Rewards will result in the cancellation of the Card Members participation in the Program, cancellation of the Card and revocation of points or return of redeemed Rewards (or its reasonable compensation thereto).

Member Benefits and Privileges

22.At all times, Member Benefits and Privileges are subject to PACIFICPOINTS’ sole and absolute discretion. PACIFICPOINTS may cancel, withdraw, alter or substitute the Member Benefits and Privileges with an alternative one at any given time.
23.PACIFICPOINTS will not be liable for any unused Member Benefits and Privileges incurred as a result of incorrect or outdated contact details or personal details registered to a Member’s account.

Accumulation of Points

24.Members shall earn PACIFICPOINTS for activities or purchases of such products and/or services ("Qualifying Purchases") with any of the participating coalition partners ("Partners"), according to the respective mechanics set out on the PACIFICPOINTS website that PACIFICPOINTS and its Partners shall designate from time to time in its absolute discretion. Members may also earn points from Loyalty Program Promotions that may be offered from time to time. Note that these points awarding mechanics are subject to modification at any time without prior notice.
25.The Card must be presented to the cashier before making the purchase, failing which, points will not be credited. Any purchase other than Qualifying Purchases shall not be awarded any point, unless otherwise notified by PACIFICPOINTS. Should the Card Member fail to present his/her card to the cashier prior to the transaction closing and the transaction has been closed, cashier will not be responsible for crediting the Member’s points for the completed transaction.
26.In the case where valid Qualifying Purchases were made but PACIFICPOINTS ID was not presented at time of purchase, Members shall be required to send email request to credit points to Customer Hotline within three (3) business days from transaction date. Members will be required to provide PACIFICPOINTS ID and clear copy of the transaction receipt. PACIFICPOINTS reserves the right to accept or reject such request at its absolute discretion.
27.Members that have an existing account in any of the participating Partners’ Rewards Program may convert their Partner rewards currency into PACIFICPOINTS or the other way around, according to the respective mechanics and conversion scheme set out on the PACIFICPOINTS website that PACIFICPOINTS and its Partners shall designate from time to time in its absolute discretion. Note that these point conversion mechanics are subject to modification at any time without prior notice.
28.Any points issued to a member will be reflected in their PACIFICPOINTS account, which is accessible via the Mobile App and/or through the Website.
29.PACIFICPOINTS and its Partners reserve the right to determine, vary or change from time to time the qualifying goods and services and/or number of points to be awarded for each dollar spent for Qualifying Purchases without prior notice or assigning any reasons whatsoever.
30.There is no maximum threshold for the number of points that a member may earn or accumulate in his/her account.
31. Points earning is calculated based on the transaction amount of Qualified Purchases. Equivalent points may vary from one Partner to another. Details of points earning by Merchant Partners are found in the Earning Points page in the website. Computation of points will be based on whole dollar amount. For Partners that award one (1) point for every dollar, here is a sample calculation:

Redemption of Points

31.A Member who has accumulated sufficient points in his/her Card and is eligible, subject to meeting any conditions that PACIFICPOINTS may impose, may redeem the same for such products, award miles, services, privileges and or as payment tender ("Rewards"), as PACIFICPOINTS shall designate from time to time at its absolute discretion. Rewards shall be listed in the prevailing Choose Rewards page and shall be subject to the terms and conditions therein.
32.Upon redemption of points for any particular Reward, the accumulated points recorded in Members account will be deducted by the corresponding number of points redeemed. In any and all circumstances, any deduction of points from the Members account may no longer be reversed, changed, revoked, or cancelled.
34.All Rewards are subject to availability and PACIFICPOINTS and its Partners have the right to substitute the Rewards with other items of similar value in the event the requested Rewards are out of stock or unavailable for whatever reason.
35.For Rewards that are to be redeemed from Partners as shall be appointed by PACIFICPOINTS from time to time, the Member shall present his/her Card and/or Rewards Voucher for redemption and shall comply with any terms and conditions imposed by such Partner. Rewards, once redeemed, cannot be revoked, exchanged, returned, or refunded.
36.PACIFICPOINTS gives no representation or warranty with respect to any products and/or services featured in the Choose Rewards page. PACIFICPOINTS gives no warranty with respect to the quality of the Rewards or their suitability for any purpose. Where the Rewards are covered under any Partners warranty, any disputes or claims shall be forwarded directly to the concerned Partner. PACIFICPOINTS will bear no responsibility for resolving any dispute concerning any products and/or services received by the Member.
37.PACIFICPOINTS does not accept liability whatsoever with respect to Rewards supplied or in connection with any refusal by Partner to accept certificates/vouchers issued for the purpose of redeeming such Rewards. Any dispute arising from or in connection with such certificates/vouchers shall be solely between the Member and such Partners.
38.Redeemed Products, Award Miles and/or Services are not exchangeable for other Products, Award Miles and/or Services, or refundable, replaceable, or be sold or transferred for cash or credit, under any circumstances.
39.Each Redemption Partner’s return and exchange policy will apply on redeemed awards.
40.Redeemed rewards are transferrable. The individual whom the Member has shared and transferred the redeemed reward must present a copy of the email notification which includes voucher details, QR code and barcode.
41. Notwithstanding any other provisions and without prejudice to any other rights and remedies stated herein, PACIFICPOINTS reserves the right to deduct accumulated points from the Card Members account or refuse the redemption of any Rewards or to recall such redeemed Rewards under the following circumstances:
  • points suspected to be fraudulently recorded or obtained;
  • any points erroneously awarded due to system glitches or any other reasons;
  • any points derived from any transaction, which has been cancelled, voided, refunded or reversed; or
  • any points derived from the purchase of inventory and stocks by a Member who is appointed to operate, manage or work at any Partner branch.
42. PACIFICPOINTS has the right, without prior notice and assigning any reasons whatsoever, to determine and change from time to time:
  • the Rewards offered in the Program as listed in any other document; and
  • the qualifying points required for redemption of Rewards.
43.PACIFICPOINTS or its representative shall not be held liable for any death or injury or consequential loss or damage of any nature arising from the redemption, supply or use of the Rewards or from the loss, theft or destruction of the Rewards. All such claims shall be directed or forwarded to the manufacturers concerned.

Voucher Redemption and Usage

44.Member may redeem vouchers by selecting such items from Choose Rewards page. Use of voucher is bound by the validity and mechanics specified for each voucher. Voucher is valid for one (1) time use only. Voucher is transferable.
45.To use voucher at the Partner Merchant, Member shall present printed or digital copy of the voucher. If voucher value is lower than transaction amount due, balance amount shall be settled using cash or other payment tenders (e.g. credit card, debit card, etc.). If voucher value is higher than transaction amount due, no change will be given.
46.Most current Voucher redemption rates are published in the PACIFICPOINTS website.

United MileagePlus Award Miles Redemption

47.Award miles issued are subject to the rules of the United MileagePlus® program. Miles conversion shall be posted to your MileagePlus account within eight (8) weeks. Award miles earned through PACIFICPOINTS do not count towards United MileagePlus elite status. Mile offers are subject to change without prior notice. United may change MileagePlus program, regulations, travel awards and special offers or terminate the Mileage Plus program at any time and without notice. Questions regarding the redemption of Miles may be directed to United at 1-800-864-8331.
48.Most current miles conversion rate is published in the PACIFICPOINTS website.

Dispute and Proof of Transaction

49.Any claim or dispute relating to the Program or the use of the Card shall be referred directly to PACIFICPOINTS for decision, which shall be final and binding on the Member and PACIFICPOINTS’ records of all matters relating to the Program shall be conclusive and binding on the Member.
50.It is the Member’s responsibility to provide proof of transaction and to provide legible receipt copies when making claims. Members must retain their legible receipt copy as proof of purchase when making a claim. Member receipts must be kept in a cool and dry location and kept out of heated or wet areas to prevent damage.
51.PACIFICPOINTS will be sending SMS and/or Email notifications to members for Loyalty Related transactions, such as but not limited to, points earning, points redemption, One Time Password, updating of profile, etc.

Coalition Partners

52.PACIFICPOINTS reserves the right to invite or allow any other company/ies to participate in the Program and in such event, to modify the Program and any of the terms and conditions provided herein or other agreements or documents relating to the Program, including the terms and conditions in relation to Rewards earning and redemption.

Disclosure of Information

53.The Member hereby authorizes PACIFICPOINTS and/or its employees or representatives to hold, make use of, disclose, divulge or reveal any information relating to the Member and the Members use of the Card in such manner and to such extent as PACIFICPOINTS shall, from time to time, deem necessary when it is required by applicable legislation, regulation, government agency or court order. PACIFICPOINTS may further disclose, divulge or reveal any information relating to the Member and the Members use of the Card to any party and/or its agents involved in the Program for research, planning, product development and direct marketing. Additionally, the Member agrees to allow their particulars and data, including data relating to purchases and mode(s) of payments, to be passed or disclosed between PACIFICPOINTS, its Affiliates and its Program Partners, Contractors or Suppliers for the purpose of maintaining Members account with and continued participation of the Program, including explicit consent stated in Send Points to a Friend and Refer a Friend.
54.By participating in the PACIFICPOINTS Loyalty Program, Member agrees to the Terms and Conditions specified herein and further agrees to receive promotional offers from PACIFICPOINTS and selected promotional partners via emails and texts or other means.
55.Should Member choose to opt out of receiving such promotion/s, he/she must log in to his/her PACIFICPOINTS account via the Mobile App or through the Website and access the Account Settings page to request for opt-out.

Exclusion of Liability

56.PACIFICPOINTS shall not be liable for any loss of accumulated points or loss or damage suffered as a result of any defect or error in any machines or inability to retrieve any information or data from the computer system.
57.Without prejudice to any other terms and conditions set out herein, any liability PACIFICPOINTS may have to Members arising out of the use of the Card or the redemption of Rewards which cannot be excluded or which is not already provided herein is hereby limited, where permitted, to the reinstatement of such points or cost of such Rewards as PACIFICPOINTS shall, at its discretion, determine.
58.PACIFICPOINTS shall not be liable for any loss or damage caused to the Member arising from any act or omission of the Partner and/or PACIFICPOINTS’ appointed agents and contractors or suppliers including without limitation, any refusal to honor or accept the Card or any statement or other communication made in connection herewith or any defective or deficient goods or services supplied. Any dispute or claim the Member may have with or against the Partner and/or PACIFICPOINTS appointed agents and contractors or suppliers shall not affect the obligations of the Member under these terms and conditions.
59.All conditions and warranties, whether expressed or implied and whether arising under any legislation or otherwise, as to the condition, suitability, quality, fitness or safety of any goods and/or services supplied in relation to the Card are expressly excluded to the extent permitted by law.
60.PACIFICPOINTS shall not be liable howsoever for any errors, delays, loss or damage, which may be directly or indirectly due to breakdown, failure of machinery or the processor; or industry dispute, war, act of God, system failure and any other instance outside the control of PACIFICPOINTS.
61. PACIFICPOINTS shall not be liable for any loss or damage suffered by the Member due to the following reasons:
  • any delay or failure in replacing the Card;
  • any damage to any Reward in the course of delivery or post;
  • any failure by the Reward supplier to abide by the terms and conditions on which it has agreed to provide the Reward;
  • any statement, communication or implication arising from any revocation, suspension or restriction of the use of the Card; and
  • any failure or omission to notify the Member of any changes in the terms and conditions of this Agreement, Reward Options, participating Partners, Qualifying Purchases and points awarded for Qualifying Purchases.

General Variation

62.The Member agrees that PACIFICPOINTS, from time to time without giving prior notice to the Member, may vary, add or amend the terms and conditions herein set out. In the event the Member is not agreeable to such variation, addition and/or amendments, the Member may deactivate his/her membership by logging in to his/her PACIFICPOINTS account via the Mobile App or through the Website Portal, failing which the Member shall be deemed to have accepted the variation, addition and/or amendments of the terms and conditions herein.


63.PACIFICPOINTS reserves the right to withdraw or terminate the Program at any time without assigning any reasons therefore. Upon notification of the withdrawal or termination, the Member shall have one month from the date of the notification or such period as PACIFICPOINTS shall state in such notice, to redeem accumulated points for available Rewards. Upon expiry of the aforesaid notice, the points remaining in the Members account shall be nullified and invalidated and PACIFICPOINTS shall have no obligations or liabilities in respect of such points, by way of compensation or otherwise, to the Member and the Member shall have no further claims whatsoever against PACIFICPOINTS.


64.Notwithstanding anything in this Agreement, PACIFICPOINTS rights and entitlement under this Agreement shall continue to remain in full force and effect and shall survive any cancellation, revocation or suspension of the Program, the use of the Card or the Members participation in the Program.
65.The invalidity or unenforceability of any of the provisions herein or any part thereof shall not substantially nullify the underlying intent of this Agreement and the invalid or unenforceable provisions of this Agreement shall not affect the validity or enforceability of the other terms and provisions herein contained which shall remain in full force and effect.
66.The terms and conditions herein stated shall be in addition to and not in derogation of any specific agreement or arrangement with regard to the Program now or hereafter, and from time to time, subsisting between PACIFICPOINTS and the Member or any terms and conditions that may be specified in any written communication sent by PACIFICPOINTS to the Member from time to time.
67.PACIFICPOINTS shall have the right to freely assign, at any time, to any affiliate or third party, these terms and conditions, the Program, the ownership of the Cards and/or the Card Members account in respect of the Program and/or any of its rights, obligations or liabilities hereunder, without the consent of the Card Member.
68.The most updated version of the PACIFICPOINTS Loyalty Program Terms and Conditions will be posted on the PACIFICPOINTS website https://pacificpoints.com which shall supersede all printed Terms and Conditions.
